I dag röstade EU-parlamentet igenom att upphovsrätten inom EU ökas till 70 år efter i stället för som tidigare 50.
Det betyder att litterära och musikaliska verk nu skyddas ännu längre än tidigare och projekt som Project Gutenberg och Projekt Runeberg måste städa undan ytterligare ett antal böcker eftersom förlängningen gäller retroaktivt.
Fy fan.
The recent enactment of the intellectual property law sometimes referred to as the ”IPRED-law” based on a European Union directive had an immediate effect on the Internet traffic. Hours after the law was put into effect the traffic load on the Swedish core network netnod was cut around 30%. A couple of days later it is down to 50% of what it was before the IPRED was put into effect.
The new law makes it possible for intellectual property owners to directly go to court to get who owns a certain IP at a certain time. This means that they may then prepare a law suit against the person that had the IP at the time of the copyright infringement and this has already been put into effect.
Only hours after the law was active several authors handed over a demand to the court in Solna to get who was using certain IP’s to download audio books from a server. This server has been pointed out as a main source for distributing copyrighted audio book material.
The anti-piracy lobby is clapping their hands. Personally I think that their victory will be a short one, traffic is already moving on to more secure systems such as OneSwarm or using anonymizers.
The Pirate Bay guys, recently also in court proceedings, have already set up a service where someone for about €5 can use their non-logging anonymizer in order to access material on the Internet in a fashion that makes it much more difficult for people to track.
They call the service the IPREDator. I’m pretty happy the Internet is fast again with the currently low traffic in and out of Sweden surfing is once again a rather pleasureable experience of course…
In some ways I don’t really see the great movement against it, I mean there is no human right to have access to pirated material on the Internet. I am personally much more worried about the current ongoing work to extend the copyright time to 95 years after the artists death which would once again – just like at the last extension when it was extended to 75 years – put severa open works once again under the yoke of being copyright.
Movements such as Project Gutenberg and Project Runeberg suffers because some of their works already published and allowed to be published ar suddenly not longer available because the extension of the copyright time works retroactively.
That’s madness. But we don’t see a hughe political movement against this madness…
Ja då var det dags igen. Just nu förhandlas det inom EU med en stark lobbying från penningstinna organisationer inom musik, film och nöjesbranscherna om ännu ett tillägg till lagen som skyddar upphovsrättsmännens tillgångar.
I detta tillägg skall man nu förlänga upphovsrättstiden till 95 år efter upphovsrättsmannens död. Man har tidigare redan i många omgångar förlängt det från de fem år som det var ursprungligen i omgångar till att gälla under hela upphovsrättsinnehavarens livstid, därefter har man förlängt det i omgångar till tjugofem, sedan femtio och sist nu sjuttio år efter hans död.
Det börjar bli löjligt, det kan inte vara meningen att upphovsrätten skall vara en för evigt gällande visa. Det finns de som påstår att Walt Disney’s Mickey Mouse är den figur som driver det hela, när det börjar bli risk för att de efterlevande till WD inte längre kan slå mynt så startar lobbyingen igen. Jag tror inte det är så enkelt, det finns flera branscher som är rädda om sitt material.
Återigen missar skiv- och filmbolagen vad folk egentligen vill ha och vill fortsätta sälja gammal skåpmat som inte kostar något. Sluta med dumheterna, släpp Elvis materiel fritt. Det borde räcka med att upphovsrätten kvarstår i ett fast antal år efter den som skapar ett verk, säg rimligtvis 20 år oavsett om artisten lever eller inte – sedan är det som upphovsrätten skall tillgodose redan förverkligat – eller så blev det inget.
Ett svenskt initiativ till det världsomspännande projekt Gutenberg befann sig i en prekär situation när upphovsrätten förlängdes senast. Plötsligt så var bokmateriel som man höll på att scanna in för att tillgängliggöra för allmänheten på projekt Runebergs websajt återigen omfattat av upphovsrätt i vissa fall efter att ha varit fritt material i över tjugo år! Det satte effektivt stopp för ett mycket berömvärt initiativ att digitalisera och publicera klassiska verk så att alla kunde få ta del av dem. Många av de här verken går inte ens med goda kontakter att uppbringa, de trycks inte längre och de är så pass sällsynta att de knappt står att finna på boklådor och antikvariat.
Det här gör mig upprörd.
The Swedish Center in San Diego have used one of my pictures without permission. I have deliberately broken the link with them now so their picture comes up with the Flickr standard logo. It is clear on everyone of my picture pages that the pictures are Copyright and I reserve all rights.
I have never said no if someone has asked me kindly to use a picture or two, I find it very flattering actually, but the Swedish Center never even linked back to my photo page (a violation of Flickr’s terms and conditions) and never even attributed me as the photographer.
Most likely they found the picture in a search engine somewhere and just used it on their web site. This is of course not legal unless the picture is explicitly a public domain photo or you have express (written) permission of the owner.
Despite me leaving a comment on the page violating my legal rights and Flickr’s terms of service there has for about a week now been no reply. The comment has not even been moderated so it is not visible to anyone else but the admins on the site or myself at the moment.
